Terms of Service

These Terms of Service (“Terms”) govern your access to and use of the HomeGoat mobile application, website at homegoat.app, and related services (collectively, the “Service”) operated by HomeGoat (“we,” “us,” or “our”). By creating an account or using the Service, you agree to these Terms and our Privacy Policy.

1. Eligibility

You must be at least 13 years old to use HomeGoat. If you are under 18, you represent that you have permission from a parent or legal guardian. You may not use the Service if you are barred from doing so under applicable law.

2. Your account

You are responsible for safeguarding your login credentials and for activity under your account. Provide accurate information and notify us promptly at support@homegoat.app if you suspect unauthorized access.

3. User content

You may post photos, comments, scores, and other content (“User Content”). You retain ownership of your User Content. By posting User Content, you grant HomeGoat a non-exclusive, worldwide, royalty-free license to host, store, display, reproduce, and distribute it solely to operate and improve the Service (including showing it to other users as the product allows).

You represent that:

• You have the rights needed to post your User Content;
• Your User Content does not violate law or third-party rights;
• Your User Content complies with these Terms and our community standards.

4. Acceptable use

You agree not to:

• Harass, threaten, defame, or abuse others;
• Post illegal, hateful, sexually exploitative, or violent content;
• Impersonate any person or misrepresent your affiliation;
• Spam, scrape, or interfere with the Service’s operation or security;
• Use the Service for unauthorized commercial solicitation;
• Circumvent blocks, reports, or other safety features.

We may remove content, suspend or terminate accounts, and cooperate with authorities when we believe conduct violates these Terms or harms users or the Service.

5. Reporting and blocking

The Service includes tools to report content and block other users. We review reports as described in the app and may take action at our discretion. We are not obligated to monitor all User Content but may do so to enforce these Terms.

6. Third-party services and links

The Service may integrate with or link to third-party services (for example, maps, live streaming, or organization websites). Those services are governed by their own terms. We are not responsible for third-party services.

7. Intellectual property

HomeGoat’s name, logos, app design, and other materials we provide are owned by us or our licensors and are protected by intellectual property laws. Except for the limited rights granted in these Terms, we reserve all rights.

8. Disclaimers

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT GUARANTEE THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE. SCORES, STATS, AND LIVE FEATURES ARE FOR ENTERTAINMENT AND ORGANIZATIONAL PURPOSES; DO NOT RELY ON THEM FOR OFFICIAL OR BETTING PURPOSES.

9. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, HOMEGOAT AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE IS LIMITED TO THE GREATER OF (A) THE AMOUNT YOU PAID US FOR THE SERVICE IN THE TWELVE MONTHS BEFORE THE CLAIM OR (B) ONE HUNDRED U.S. DOLLARS ($100).

10. Indemnity

You agree to indemnify and hold harmless HomeGoat from claims arising out of your User Content, your use of the Service, or your violation of these Terms or applicable law.

11. Termination

You may stop using the Service at any time. We may suspend or terminate your access if you violate these Terms or if we discontinue the Service. Sections that by their nature should survive termination will survive.

12. Changes

We may modify these Terms. We will post updates on this page with a new effective date. Material changes may also be communicated in the app. Continued use after changes constitutes acceptance.

13. Governing law

These Terms are governed by the laws of the United States and the State of New York, without regard to conflict-of-law principles, except where mandatory local law applies. Disputes will be resolved in the state or federal courts located in New York, New York, unless applicable law requires otherwise.
